ROUTE PLANNER PRIVACY POLICY

Route Planner LLC ("Route Planner," "we," "us," or "our") respects the privacy of individuals whose information is processed through our websites, applications, software, and related services.

This Privacy Policy explains how we collect, use, disclose, retain, and otherwise process personal information.

It also explains certain choices and privacy rights that may be available to you.

1. SCOPE OF THIS PRIVACY POLICY

This Privacy Policy applies to personal information Route Planner processes in connection with:

Route Planner accounts;

demonstrations and trials;

This Privacy Policy does not govern the independent privacy practices of Route Planner customers or third-party services.

2. ROUTE PLANNER'S DIFFERENT PRIVACY ROLES

Route Planner processes personal information in different capacities depending upon the circumstances.

A. Information Route Planner Controls

Route Planner generally determines the purposes and means of processing information relating to:

Account administrators;

prospective customers;

website visitors;

Route Planner's sales contacts;

billing contacts;

individuals contacting Route Planner support; and

Route Planner's own business relationships.

For this information, Route Planner generally acts as a "business," "controller," or equivalent entity under applicable privacy law.

B. Information Processed for Our Customers

Route Planner customers may use the Service to process information concerning:

their customers;

prospective customers;

technicians;

employees;

contractors;

suppliers;

vendors;

contacts;

drivers; and

other individuals.

When Route Planner processes this information solely on behalf of a customer and according to that customer's instructions, the customer generally determines why and how the information is processed.

In those circumstances, Route Planner generally acts as a "service provider," "processor," or equivalent entity.

Individuals with questions concerning information entered into Route Planner by one of our customers should generally contact that customer directly.

3. CATEGORIES OF INFORMATION WE MAY COLLECT

Depending upon how Route Planner is used, we may process the following categories of information.

A. Account and Identity Information

This may include:

name;

username;

business name;

job title;

profile information

account identifiers;

authentication information; and

user role.

B. Contact Information

This may include:

email address;

telephone number;

mailing address;

business address; and

other contact details.

C. Business Information

This may include:

company name;

industry;

company size;

service areas;

subscription information;

account configuration;

authorized users; and

business preferences.

D. Customer and CRM Information

Customers may upload or create information concerning their own customers and prospects, including:

contact information;

service addresses;

notes;

appointment information;

customer histories;

communications;

job information;

preferences; and

related business records.

E. Employee, Technician, and Contractor Information

Customers may enter information concerning employees, technicians, contractors, or workers, including:

names;

contact details;

schedules;

assignments;

job activity;

technician status;

timestamps;

performance-related business information; and

location information.

F. Location Information

Depending on enabled features and device permissions, Route Planner may process:

GPS coordinates;

technician or vehicle locations;

job locations;

customer addresses;

route information;

check-in locations;

travel information; and

approximate device location.

Location accuracy depends on the device, operating system, permissions, network availability, and third party services.

Customers are responsible for providing legally required notices and obtaining legally required consent before using Route Planner to collect worker location information.

G. Job and Scheduling Information

This may include:

appointment times;

service dates;

work orders;

technician assignments;

job status;

route assignments;

job notes;

recurring service information;

service history; and

estimated arrival information.

H. Asset, Vehicle, Equipment, Inventory, and Consumable

Information This may include:

asset names;

equipment records;

serial or identifying numbers;

vehicle information;

maintenance information;

supplier information;

quantities;

stock information;

consumables;

purchase information; and

related records.

I. Invoice and Transaction Information

This may include:

invoices;

quotes;

estimates;

purchase orders;

payment status;

transaction amounts;

refunds;

credits;

tax-related fields; and

payment references.

Payment card transactions may be processed by third-party payment providers.

Route Planner does not intend for Customers to place full payment card information or card verification codes into ordinary notes or undesignated data fields.

J. Communications

We may process communications transmitted through or relating to the Service, including:

support requests;

emails;

appointment messages;

templates;

notifications;

customer service communications;

message content; and

message delivery information.

K. Integration Data

If a Customer connects Route Planner with a third-party service, we may receive or transmit information necessary to provide the requested Integration.

The information exchanged depends upon the Integration and permissions selected.

L. Device and Technical Information

We may automatically collect information such as:

IP address;

browser type;

operating system;

device information;

application version;

language;

referring URLs;

session information;

diagnostic information;

crash information;

timestamps; and

technical identifiers.

M. Usage Information

We may collect information regarding how the Service is used, including:

pages viewed;

features used;

clicks;

navigation;

session activity;

configuration activity;

feature interaction;

login activity; and

Service performance.

N. Cookies and Similar Technologies

Our websites and applications may use cookies, local storage, pixels, SDKs, and similar technologies for purposes such as:

9. from other persons who interact with Route Planner.

5. HOW WE USE PERSONAL INFORMATION

Depending upon the circumstances, we may process personal information to:

create and maintain Accounts;

authenticate users;

provide the Service;

schedule and manage jobs;

provide routing functionality;

support technician management;

manage customer records;

facilitate communications;

provide invoice and payment-related functionality;

manage assets and inventory;

provide requested Integrations;

process Subscription payments;

respond to support inquiries;

troubleshoot technical problems;

monitor Service performance;

prevent fraud;

protect Accounts;

detect misuse;

maintain cybersecurity;

investigate security incidents;

comply with legal obligations;

enforce contracts;

maintain business records;

communicate administrative information;

understand Service usage;

improve existing features;

develop new functionality;

perform analytics;

provide demonstrations;

market Route Planner where legally permitted; and

establish, exercise, or defend legal claims.

6. PURPOSE LIMITATION

Route Planner seeks to process personal information in a manner reasonably necessary and proportionate to the purposes for which it was collected.

Where applicable law requires additional consent before information can be used for a materially different purpose, we will seek that consent.

We encourage Customers and users to enter only information reasonably necessary for legitimate business purposes.

Customers should avoid placing highly sensitive information in free-form notes, custom fields, attachments, or other areas of the Service unless necessary and legally permitted.

8. HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose personal information to the following categories of recipients where reasonably necessary.

A. Service Providers and Processors

We may use third parties to provide:

cloud hosting;

database services;

security;

communications;

analytics;

customer support;

payment processing;

email delivery;

mapping;

software infrastructure;

monitoring;

error reporting; and

other operational services.

These providers may process information on our behalf subject to applicable contractual restrictions.

B. Customer Account Administrators

Information associated with an Authorized User may be visible to administrators of the business or organization providing that user's Route Planner Account.

C. Third-Party Integrations

When Customer enables an Integration, we may disclose information to or receive information from the applicable third-party provider according to Customer's instructions.

D. Professional Advisers

We may disclose information where reasonably necessary to attorneys, accountants, auditors, insurers, consultants, financial institutions, and professional advisers.

E. Legal and Governmental Authorities

We may disclose information if we reasonably believe disclosure is required by:

law;

regulation;

subpoena;

court order;

governmental request;

legal process; or

other lawful authority.

F. Security and Protection

We may disclose information where reasonably necessary to:

detect fraud;

investigate abuse;

respond to cybersecurity incidents;

protect Route Planner;

protect Customers;

protect users;

protect third parties;

enforce agreements; or

prevent unlawful activity.

G. Corporate Transactions

Information may be transferred or disclosed in connection with:

financing;

investment;

merger;

acquisition;

reorganization;

bankruptcy;

sale of assets; or

sale or transfer of all or part of Route Planner's business.

Any recipient will remain subject to applicable legal obligations concerning the information.

9. SALE OF PERSONAL INFORMATION

Route Planner does not sell Customer Data or End Customer personal information for monetary consideration.

Route Planner also does not permit third parties to purchase Customer Data for their own independent marketing purposes.

If Route Planner's practices change in a manner that constitutes a "sale" or "sharing" of personal information under applicable privacy law, Route Planner will update this Privacy Policy and provide legally required opt-out mechanisms before engaging in such activity where required.

10. TARGETED ADVERTISING

Route Planner does not use Customer Data or End Customer Data to provide third-party advertising to individuals.

If Route Planner uses advertising technologies on its public marketing website that constitute targeted advertising or cross-context behavioral advertising under applicable law, we will provide legally required disclosures and choices.

11. CUSTOMER DATA IS NOT ROUTE PLANNER'S MARKETING LIST

Route Planner will not use End Customer contact information contained within Customer Data to independently market unrelated Route Planner products directly to those End Customers merely because a Customer entered their information into Route Planner.

12. AGGREGATED AND DE-IDENTIFIED DATA

We may create aggregated or de-identified information so that it does not reasonably identify a particular individual.

We may use such information for purposes including:

analytics;

security;

research;

benchmarking;

Service improvement;

product development;

capacity planning; and

understanding industry or usage trends.

Where required by applicable law, Route Planner will take reasonable measures designed to prevent de identified information from being associated with a particular individual and will not attempt to re identify it except as legally permitted.

13. PAYMENT PROVIDERS

Payment information may be processed by third-party payment processors.

Those providers independently determine certain aspects of their processing and maintain their own privacy policies.

Route Planner may receive limited payment-related information such as:

payment status;

transaction identifier;

payment method type;

last digits of a payment card;

billing name;

billing address; or

related transaction information.

14. THIRD-PARTY SERVICES

The Service may contain links to or integrations with third-party websites and services. Route Planner does not control the privacy practices of third parties.

We encourage users to review the privacy policies of third-party services before providing them with information.

15. SECURITY

Route Planner uses administrative, technical, and organizational safeguards reasonably designed to protect personal information against unauthorized access, destruction, alteration, or disclosure.

However, no method of electronic transmission, internet storage, or information-security system can be guaranteed to be completely secure.

Users and Customers are responsible for protecting their passwords, authentication credentials, devices, and Account access.

16. DATA BREACH AND SECURITY INCIDENT RESPONSE

Route Planner maintains processes designed to investigate suspected security incidents.

If an incident triggers a legal notification requirement, Route Planner will provide notifications as required by applicable law.

Customers agree to provide reasonable cooperation where an incident affects information they control.

17. DATA RETENTION

We retain personal information for only as long as reasonably necessary for purposes including:

providing the Service;

maintaining Customer Accounts;

fulfilling contractual obligations;

maintaining appropriate business records;

resolving disputes;

preventing fraud or abuse;

protecting security;

complying with legal obligations; and

establishing or defending legal claims.

Retention periods may vary depending on the type of information and the circumstances.

Customer Data may be retained for a limited period following Account termination to permit recovery, backup processing, legal compliance, fraud prevention, or dispute resolution.

Backup copies may remain for additional periods until overwritten or deleted through normal backup cycles.

18. CUSTOMER-CONTROLLED RETENTION

Customers may have tools to delete or modify information within the Service.

A Customer's deletion of information may not immediately remove every copy from backup systems.

Information may also be retained where legally required or reasonably necessary for security, fraud prevention, dispute resolution, or legal claims.

19. ACCOUNT TERMINATION

When an Account is terminated, Authorized Users may lose access to information associated with the Account.

Businesses using Route Planner should export information they are legally or operationally required to retain before terminating their Account.

20. PRIVACY RIGHTS

Depending upon where you live and the applicable law, you may have rights concerning your personal information.

These may include the right to:

confirm whether we process personal information about you;

access certain personal information;

obtain a copy of certain information;

correct inaccurate information;

request deletion;

request portability;

opt out of certain sales of personal information;

opt out of certain targeted advertising;

opt out of certain qualifying profiling;

limit certain uses of sensitive personal information;

withdraw consent where processing is based on consent; and

appeal certain privacy-request decisions.

These rights are subject to applicable exceptions, verification requirements, and jurisdictional limitations.

21. CUSTOMER-CONTROLLED INFORMATION AND PRIVACY REQUESTS

If your personal information was entered into Route Planner by one of our Customers, that Customer generally controls the information.

For example, if a service company uses Route Planner to maintain your customer record, that service company may be the appropriate party to contact regarding access, correction, or deletion.

If we receive a request relating to Customer-controlled information, we may direct the requester to the applicable Customer or assist the Customer with responding as required by applicable law.

22. SUBMITTING A PRIVACY REQUEST

Requests concerning personal information controlled directly by Route Planner may be submitted through:

Please describe your request and provide sufficient information for us to identify the relevant records.

23. IDENTITY VERIFICATION

We may take reasonable steps to verify the identity and authority of a person making a privacy request. Verification may depend upon:

the type of request;

the sensitivity of the information;

the risk of unauthorized disclosure; and

applicable legal requirements.

We will not disclose sensitive Account information solely because someone claims to be the Account holder.

24. AUTHORIZED AGENTS

Where applicable law allows an authorized agent to submit a privacy request, we may request evidence establishing the agent's authority.

We may also verify the identity of the individual who is the subject of the request where legally permitted.

25. APPEALS

Where applicable privacy law provides a right to appeal our decision concerning a privacy request, you may submit an appeal using the contact information provided in this Privacy Policy.

Please identify the original request and explain why you believe our decision should be reconsidered.

26. NON-DISCRIMINATION

Route Planner will not unlawfully discriminate against individuals for exercising privacy rights provided by applicable law.

27. CALIFORNIA PRIVACY DISCLOSURES

This section applies to the extent the California Consumer Privacy Act, as amended ("CCPA"), applies to Route Planner's processing.

During the preceding twelve (12) months, depending upon the individual's interaction with Route Planner, we may have collected categories of information corresponding to:

identifiers;

customer-record information;

commercial information;

internet or other electronic network activity;

geolocation information;

professional or employment-related information;

inferences generated from applicable information;

communications;

and other personal information described in this Privacy Policy.

The particular categories collected depend on the relationship between the individual and Route Planner.

We collect and use these categories for the business and commercial purposes described in this Privacy Policy.

We may disclose these categories to the recipient categories described in the "How We Disclose Personal Information" section.

Route Planner does not sell Customer Data or End Customer information for monetary consideration.

Where California law treats particular advertising disclosures as "sharing," Route Planner will provide any opt-out mechanism required by applicable law.

California residents may have rights to:

know;

access;

correct;

delete;

obtain information regarding collection and disclosure;

opt out of qualifying sale or sharing;

limit qualifying use of sensitive personal information; and

receive equal service and pricing notwithstanding exercise of applicable privacy rights. These rights are subject to statutory limitations and exceptions.

28. SENSITIVE PERSONAL INFORMATION

Route Planner generally discourages Customers from uploading highly sensitive information unless it is reasonably necessary for use of the Service.

Depending on enabled features, certain information, including precise location information, may qualify as sensitive personal information under some laws.

Customers are responsible for determining whether consent or another lawful basis is required before processing sensitive information through Route Planner.

Route Planner will process sensitive Customer Data according to Customer instructions and applicable law.

29. PRECISE GEOLOCATION

Certain Route Planner functionality may process precise or approximate geographic information. Location information may be used to:

display technician locations;

facilitate dispatch;

calculate routes;

estimate travel;

associate activity with a job;

verify service locations;

assist scheduling; and

provide other location-enabled features selected by the Customer.

The Customer is responsible for enabling these features lawfully and informing individuals of any monitoring required by applicable law.

30. WORKPLACE PRIVACY

Businesses using Route Planner are responsible for complying with employment and workplace privacy laws concerning employees, technicians, drivers, contractors, and other workers.

Route Planner does not determine whether a Customer is legally permitted to track a particular worker.

Individuals concerned about workplace monitoring performed by a Route Planner Customer should generally contact their employer or contracting business.

31. MARKETING COMMUNICATIONS

We may send marketing communications concerning Route Planner where legally permitted.

You may unsubscribe from marketing email by using the unsubscribe mechanism in the message or contacting us.

Opting out of marketing communications does not prevent us from sending non-promotional communications relating to:

your Account;

security;

billing;

legal notices;

customer support; or

operation of the Service.

32. SMS AND MOBILE COMMUNICATIONS

If you separately consent to receive text messages from Route Planner, message and data rates may apply depending on your mobile carrier.

You may opt out of applicable promotional text messages using the instructions contained in the messages.

A Customer's use of Route Planner to send messages to its own customers is controlled by that Customer, not by Route Planner for independent marketing purposes.

33. COOKIES AND ANALYTICS

We may use first-party and third-party technologies to maintain sessions, authenticate users, detect security events, remember preferences, understand usage, and measure Service performance.

Browser settings may allow you to block or delete certain cookies.

Blocking essential cookies may prevent portions of the Service from working properly. Where legally required, we obtain affirmative consent through our Cookie Preference Center before activating particular non-essential technologies. You can review or change those choices at any time via Cookie Settings, and more detail is in our Cookie Policy at https://route-planner.com/legal/cookie-policy.

34. UNIVERSAL OPT-OUT PREFERENCE SIGNALS

Where applicable law requires recognition of qualifying universal opt-out preference signals and such signals apply to our processing, Route Planner will process them as required by applicable law. Global Privacy Control (GPC) is treated as an opt-out of advertising / targeted-advertising technologies on our Online Services.

35. DO NOT TRACK

Some browsers transmit "Do Not Track" signals.

Because there is not one universally applied industry standard governing all Do Not Track signals, our response may depend on applicable law and the technologies involved.

This does not affect legally required recognition of qualifying universal opt-out mechanisms.

36. CHILDREN'S PRIVACY

Route Planner is a business service and is not directed to children under thirteen (13). Children are not permitted to create Route Planner Accounts.

We do not knowingly solicit personal information directly from children for the purpose of creating Route Planner Accounts.

If we learn that a child has directly provided personal information to Route Planner in circumstances prohibited by law, we will take reasonable steps to address the information.

Customer-entered information concerning minors remains subject to the Customer's responsibility to ensure lawful collection and use.

37. PROTECTED HEALTH INFORMATION

Route Planner is not intended to be used to process protected health information subject to HIPAA unless Route Planner has expressly agreed in writing to provide applicable HIPAA-compliant functionality and entered into a required Business Associate Agreement.

Customers should not upload protected health information to Route Planner unless such an agreement is in effect.

38. INTERNATIONAL USERS

Route Planner's primary Service offering is intended for business use in jurisdictions Route Planner supports.

If personal information is transferred across national borders, Route Planner will use legally required transfer mechanisms where applicable.

Customers operating in multiple countries are responsible for determining whether their use of Route Planner complies with laws applicable to Customer's own collection and use of Customer Data.

39. DATA PROCESSING AGREEMENTS

Where required by applicable law or commercial agreement, Route Planner may enter into a Data Processing Addendum governing Route Planner's processing of Customer Data.

Such agreements may address matters including:

processing instructions;

confidentiality;

security;

subprocessors;

privacy rights assistance;

security incidents;

deletion or return of information;

audits or assessments;

international transfers; and

the respective responsibilities of Route Planner and Customer.

40. SUBPROCESSORS

Route Planner may engage subprocessors and service providers to assist with Service delivery. These providers may include companies providing:

cloud infrastructure;

database services;

authentication;

communications;

mapping;

payments;

analytics;

monitoring;

customer support;

cybersecurity; and

related technology services.

Route Planner will impose appropriate contractual obligations on subprocessors where required by applicable law.

41. CORPORATE TRANSACTIONS

If Route Planner is involved in a merger, acquisition, financing, restructuring, bankruptcy, sale of assets, or similar corporate transaction, personal information may be reviewed, transferred, or disclosed as part of that transaction.

Any processing remains subject to applicable law.

42. LEGAL PRESERVATION

Even after a deletion request or Account termination, Route Planner may preserve information when reasonably necessary to:

comply with law;

enforce agreements;

establish or defend legal claims;

investigate fraud;

address cybersecurity incidents;

resolve billing disputes;

comply with tax or financial recordkeeping obligations; or

protect Route Planner or others.

43. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically to reflect:

product changes;

legal developments;

technology changes;

operational changes; or

changes in our information practices.

The "Last Updated" date identifies when this Privacy Policy was most recently revised.

Where required by applicable law, we will provide additional notice or obtain consent before materially changing our processing practices.

45. PRIVACY REQUESTS FROM ROUTE PLANNER CUSTOMERS' END USERS

If Route Planner processes your information solely because you interact with a business that uses Route Planner, please contact that business first.

Route Planner does not generally have authority to independently change or delete a Customer's business records without Customer authorization unless required by law.

We may forward your request to the applicable Customer or provide reasonable assistance to that Customer.

46. QUESTIONS ABOUT THIS POLICY

If you do not understand how a particular Route Planner feature processes information, contact us before using that feature with sensitive or regulated information.

Using the Service does not eliminate a Customer's independent responsibility to determine whether its own data practices comply with applicable privacy, employment, telecommunications, consumer protection, or other laws.
